Please read our Terms and Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Apley Farm Shop makes the products available to you ("Product Terms").
i. We reserve the right to update these Terms and Conditions from time to time. Updated Terms and Conditions will be published on our Delishop website.
ii. Please ensure you read our Terms and Conditions periodically so you are aware of any changes.
iii. Nothing in these terms and conditions is intended to limit any rights you may have as a consumer under any laws or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury caused by our negligence.
1. Food tastes better from the farm
We have hand selected and tasted (one of the nicest bits about working at Apley) all the food and drink we sell online and in our farm shop in Shropshire. Everybody who visits Apley always says ‘I wish that I had an Apley near me’. Unfortunately we can’t do that just yet, so buying online via www.clicboxshop.co.uk/apleyfarmshop is the next best thing.
2. Customer satisfaction
We want you to really enjoy your Apley Farm Shop produce so if there is anything you aren’t 100% happy with then please let us know straight away. See contact details below. We will do everything we can to put it right for you.
3. Information about our products
i. The best before and use by dates will vary on the products and will be clearly marked on the labels of each item. If you have any questions on a product’s best before date then please contact us.
ii. We will ensure that everything is within date when it is dispatched.
iii. Please note that some of the products may contain traces of nuts but again, if you require further information on the allergens and ingredients, please carefully review the product details or contact us. All details of allergens can be found on each product page on the website and are labelled on the products individually.
i. Some of our products contain alcohol. Under the 2003 Licensing Act, it is an offence to purchase or attempt to purchase alcohol if you are under the age of 18. We will not supply alcohol to anyone who is, or appears to be, under the age of 18.
ii. By placing an order for alcohol you confirm that you are at least 18 years old.
iii. We reserve the right to cancel your order if we are unsure of your age and you cannot provide satisfactory proof of age.
5. Prices and VAT
i. All prices are expressed inclusive of VAT where applicable.
ii. Prices are confirmed at the time of order.
i. To place an order with us online you must be 18 years or over.
ii. Orders must be placed before 1pm for collection within 3 days. Butchery products and off the shelf items are usually available for earlier collection, however this is subject to availability. Bakery products are generally made to order so collection may be up to 3 days after ordering at peak times. We will confirm your collection time on your order confirmation. If you have any questions please call us.
iii. You will not be able to collect your order before the specified collection time.
iv. You can specify your collection date and order our items for advanced collection– at checkout in “Delivery Summary” simply write your desired collection date e.g “Collection for 23rd December” in the field entitled “Any other instructions to supplier”. We will endeavour to confirm your requested date for you wherever possible. We will contact you if your date is unachievable.
7. Availability and Substitutes
i. Every order is subject to availability and our confirmation.
ii. To ensure availability of all our products, customers may be limited to a maximum number of items at our discretion.
iii. Although we will always endeavour to fulfil your order, if all or part of your order is unavailable we will contact you by email or telephone as soon as possible. In such circumstances you may choose to delay your collection date until the product is available, or cancel the item from your order and we will organise a refund.
iv. If we are unable to supply a particular item, we will not be liable for any loss or inconvenience to you.
v. We regret we are unable to make substitutes.
8. Sales contract
i. Your order is your offer to buy from us, but it is not the sales contract.
ii. The legal sales contract is formed between us when we email you your order confirmation, confirming your items available for collection and the date and time to collect from Apley Farm Shop.
iii. We reserve the right to refuse any order. We cannot be held liable for any loss or inconvenience to you.
iv. The sales contract between us is subject to availability and these Terms and Conditions.
v. A person who is not named on the contract shall not have any rights under or in connection with it.
vi. An order cannot be collected without your order number and collection time, which will be on your order confirmation from us by email to the email address provided by you.
vii. If you have any queries regarding your order confirmation please call Apley Farm Shop on 01952 730 345.
viii. Please refer to section 10A and 10D for cancellation of contract.
9. Click and Collect
i. Apley Farm Shop produce is currently only available for Click and Collect from Apley Farm Shop. Home delivery is not currently available.
ii. When we confirm your order, you will be provided with a collection date and time slot. Please note that you will be unable to collect your order earlier than the specified time and all orders can only be collected during our shop opening hours.
iii. Please bring your order number and proof of identification. We will not be able to give you your order unless you produce an appropriate form of identification. See 8.vi.
iv. We will not release products to any person who is not on the order confirmation. Extra names can be added in the ‘Any other instructions’ box at the checkout.
v. Whilst we make every effort to have your order ready for collection at the agreed time, please note we will not be liable if we fail to do so in part or in full due to circumstances beyond our control. We will contact you as soon as reasonably possible in such circumstances.
vi. As many of our products are fresh and require chilling, if you fail to collect your order within one day of the agreed time without notifying us, the order will be cancelled and no refund issued. We cannot accept liability for any loss or inconvenience to you.
10. Returns, Refunds and Cancellations
While we hope you’ll be happy with the items you order from our website, we know you may sometimes need to return them. If you do, below is all the information you’ll need to know.
Product Cancellation period
Fresh food items/Made–to-order items/Chilled items/Short shelf life items:
You can cancel freshly made food and bespoke / made–to-order items at any time before you receive your order confirmation email from us. Simply call us on 01952 730 345 or email us email@example.com. These are otherwise non-cancellable, non-exchangeable and non-refundable, unless faulty.
Other food and drink:
You may cancel other food and drink items within 14 days of receipt by calling on 01952 730 345 or emailing us on firstname.lastname@example.org.
A. Cancelling items if you’ve changed your mind
i. If on examining your goods on collection you change your mind about an item, you can leave the item in Apley Farm Shop, subject to agreement by our shop manager.
ii. Please note freshly made food, bespoke or made–to-order items are non-cancellable, non-exchangeable and non-refundable unless defective, once you have received your order confirmation.
iii. You may cancel and return an item within 14 days of receipt by notifying us by email or telephone. The item must be unopened with all original packaging, tags, labels and any accessories intact for sale. You will need to take reasonable care of the item whilst in your possession (reasonable care includes inspecting an item, but would not extend to your opening and/or using it). If you damage an item whilst it is in your possession, there may be a deduction from your refund, otherwise it will be non-refundable.
iv. If you are unable to get to Apley farm shop, you are responsible for paying for the return of goods, if you’ve changed your mind and wish to cancel your order. We recommend you use a signed for delivery with proof of postage.
v. We will request a refund through our online DeliShop site once goods have been verified they are suitable for refund.
vi. Please note no refunds can be given in the farm shop for online purchases.
B. Returns of faulty or poor quality items
i. We do our best to make sure everything reaches you in perfect condition, but if it doesn’t, we’re here to help. If you find any Apley Farm Shop product which is faulty or of poor quality, please call us on 01952 730 345.
ii. For perishable items we ask you do this no later than 3 days from collection and within the Use By date.
iii. We may require you to bring the items in question back to Apley Farm Shop.
iv. We always recommend that you inspect your order carefully before leaving Apley Farm Shop.
C. Receiving your refund
iv. We may be happy to offer a full or partial refund, subject to the shop manager’s discretion on inspection in the shop and the product’s shelf life. You will need to bring proof of purchase and identity with you.
v. Your money will be refunded to you in the same way you paid for your product – via the same card you used and through WorldPay via our Delishop website.
vi. After you have returned your item(s), please allow up to 14 days for the refund to show in your account. If you have not received your refund nor a refund acknowledgement from us after 15 days, you should contact ClicBox DeliShop direct on email@example.com.
vii. Refunds will not exceed the total price charged for the relevant items. If your item was purchased at an offer price, your refund will be based on that promotional price.
viii. If you do not advise us of any damaged goods within the stated time periods (3 days for fresh items and not exceeding the Use By date, 14 days for non-food items), you cannot return the goods to us.
ix. Unless the law provides otherwise, we will not be responsible for any loss of profits, business or goodwill (or similar loss) which you may suffer because of any problem about which you notify us and we shall have no responsibility to pay any money to you by way of compensation other than to refund you the amount paid by you for the goods in question.
D. Cancellation by us
i. We reserve the right to cancel the contract at any time if the order cannot be fulfilled for reasons beyond our control, or if we believe a customer has acted against these Terms and Conditions. This includes any customer who we have suspended from Apley Farm Shop, non-payment of ordered products and fraudulent use of our website and/or sales.
ii. We cannot be held liable for any loss or inconvenience caused.
11. Risk and ownership
i. Ownership, including risk of damage to or loss of the goods passes to you when you collect your order from Apley Farm Shop.
ii. We cannot accept any liability for any loss or damage to the goods after you have collected your order (unless this is caused by our negligence).
i. By ordering from our website, you agree not to commercially resell any of our products.
ii. Commercially reselling our products is a breach of these terms and conditions and your agreement with us.
i. We respect your privacy. Apley Farm Shop manages your personal data in accordance with The Data Protection Act 1998. Apley Farm Shop will not sell or pass on your information to any third party.
ii. We need to use your address, email and telephone number to process your order.
iii. We do not collect any sensitive data nor do our staff see any transactional data or your card details.
iv. We will not contact you for our marketing purposes unless you have given us your prior written consent.
v. In the event of data damage or loss by us, our liability is strictly limited to the minimum within that UK and EU legislation.
14. Intellectual property
i. The content concerning Apley Farm Shop on this website is protected by copyright, trademarks, database rights and other intellectual property rights.
ii. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website without prior written permission from Apley Farm Shop.
15. Governing law
i. The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
